We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.
User Responsibilities
Acceptable Use
You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use our services for any illegal or unauthorized purpose
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Transmit any harmful or malicious code
- Attempt to gain unauthorized access to our systems
Data Accuracy
You are responsible for ensuring that all data and information provided to us is accurate, complete, and legally obtained. You warrant that you have the necessary rights to provide such data for AI model training and development.
Intellectual Property Rights
Our IP Rights
All content, features, and functionality of our services, including but not limited to text, graphics, logos, software, shared components and AI models developed by us, are owned by Artelify and are protected by copyright, trademark, and other intellectual property laws.
Client IP Rights
You retain ownership of your data, derived data from your data, and any pre-existing intellectual property. Web and mobile applications, automation workflows, custom trained AI models with your data, and software tools developed specifically for your use case will be owned by you, subject to our retained rights in underlying technologies and methodologies.
Limitation of Liability

Service Availability: We strive to maintain high service availability but do not guarantee uninterrupted access. Our services are provided "as is" without warranties of any kind.
AI Model Performance: While we use best practices in AI development, we cannot guarantee specific performance outcomes. AI models may have limitations and biases inherent to the training data and methodologies.
Limitation of Damages: In no event shall Artelify be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or use, arising out of or relating to these terms or our services.
Termination
Either party may terminate the service agreement with 30 days written notice. We may terminate or suspend access immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Upon Termination:
- Your right to use our services will cease immediately
- We will provide reasonable assistance in data migration
- Outstanding payments remain due
- Confidentiality obligations survive termination
Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Virginia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
Dispute Resolution Process:
- Good faith negotiation (30 days)
- Mediation (if negotiation fails)
- Binding arbitration (final resolution)
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through our website. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.
